OneByNext is operated by OneByNext ("we", "us"). These Terms of Service ("Terms") govern your use of the onebynext.com website (together, the "Service"). By using the Service you agree to these Terms.
2. The Service
OneByNext provides operational software for logistics delivered as a subscription service. Features, modules, and availability are described on our website and in your subscription agreement. We continuously improve the Service; features may change over time without materially reducing the functionality you pay for.
3. Accounts
You are responsible for the accuracy of the information in your account, for keeping your credentials confidential, and for all activity under your account. Notify us immediately at info@onebynext.com if you suspect unauthorized use.
4. Your data
Data you enter into the Service — shipments, customers, drivers, inventory, financial records — belongs to you. We process it solely to provide the Service. On termination you may request an export of your data; we will provide it in a standard machine-readable format.
5. Acceptable use
You agree not to misuse the Service: no unauthorized access attempts, no interference with other tenants, no use of the Service to violate applicable law (including transportation and data-protection regulations), and no reselling of the Service without a written agreement with us.
6. Subscription and fees
Fees, billing cadence, and any locked founding-partner rates are set out in your subscription agreement. Unless that agreement says otherwise, subscriptions renew automatically and can be cancelled effective at the end of the current billing period.
7. Availability and disclaimer
We work to keep the Service available and reliable, but it is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on this page with an updated date above, and — for active subscribers — by email. Continued use of the Service after a change takes effect constitutes acceptance.
